Defendant sought review of a
decision of the Circuit Court of Fairfax (Virginia), which convicted defendant
of driving a motor vehicle while he had a blood alcohol concentration of .10
percent or more (DUI) pursuant to Va. Code Ann. § 18.2-266(i).

The
Virginia Court made the following holding:
- Va. Code Ann. § 18.2-266
provides in part that it shall be unlawful for any person to drive or
operate any motor vehicle (i) while such person has a blood alcohol
concentration of 0.10 percent or more by weight by volume as indicated by
a chemical test administered in accordance with the provisions of Va. Code
Ann. § 18.2-268, or (ii) while such person is under the influence of
alcohol. The
prescribed measurement of blood alcohol level under Va. Code Ann. §
18.2-266(i) is an evidentiary fact which creates a rebuttable presumption
that the measurement accurately reflects the blood alcohol concentration
at the time of driving.
